This policy applies to your use of the Kava Mobile Application software (the “Application”), developed by Zeepo Limited and available on Google play store, once you have downloaded the app onto your mobile phone or handheld device. This policy sets out the basis for acquisition, usage and/ or transmission of your personal data by Kava in the course of your usage of the Application.

The Application is a financial services interface that currently enables registration and consumption of the Kava Services for qualified users.

This Policy shall be read together with Kava’s Mobile Application Terms and Conditions.

Information obtained by the App and how is it used

  1. User-provided Information 
    1. The Application obtains the information you provide upon downloading and accepting the Kava’s Mobile Application Terms and Conditions.
    2. Registering the Application is optional. However, some features of the Application may only be available upon acceptance of the Kava’s Mobile Application Terms and Conditions, and subsequent registration.
    3. During the registration process,  Kava shall require from you:
      1. your name, email address, age, user name, password and other personal information that Kava, in its sole discretion, may deem relevant for purposes of registration;
      2. transaction-related information, such as date and time of creation of  a loan account, date and time of repayment of a loan, response to any offers, or downloads or use applications from Kava;
      3. information you provide to Kava when you contact it for help;
      4. credit card information for purchase and use of the Application, and;
      5. information you enter into Kava’s system when using the Application, such as contact information.
    4. Kava may also use the information specified in Clause A (iii) above  to contact you from time to time; and to provide you with relevant information, required notices and marketing promotions.
  2. Automatically-Collected Information
    1. Additionally, the Application may automatically collect certain information regarding the mobile device used to access the Application. Such information includes but is not limited to:<
      1. the model of mobile device used to access the Application;
      2. unique device identifiers including but not limited to, the mobile device’s  IMEI or serial number
      3. mobile network information;
      4. the mobile device’s operating system;
      5. the web and/or internet browser installed on the mobile device in the course of accessing the Application;
      6. the mobile  Device’s location and time zone setting as at the time of accessing the Application; and
    2. When you visit the Application, you irrevocably acknowledge and agree that Kava may use GPS technology (or other similar technology) to determine your current location in order to display a location map with relevant advertisements.
    3. Kava irrevocably acknowledges and agrees to refrain from sharing your current location with other users or partners unless compelled by any court order or competent authority or agency under the applicable laws
    4. If you would not want Kava to use your location for the purposes set forth above, you are advised to turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application.
  3. Access to Information Obtained Through the Application by Third Parties

    2. Kava agrees not to share your information with third parties only in the ways that are described in this privacy statement.
    3. Kava may disclose User-Provided and Automatically Collected Information under the following circumstances:
      1. as required by law, such as to comply with a court summons, , court order or similar directive derived from a duly-recognized legal process from a court,  competent authority or agency under the applicable laws;
      2. when and if Kava has sufficient reason to believe that such disclosure is necessary to protect Kava’s rights, protect your safety or the safety of the general public, investigate fraud, or in response to a government request;
      3. with our trusted services providers who work on our behalf and do not have the right to independently use  the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement; and
      4. if Zeepo Limited is involved in a merger, acquisition, or sale of all or a portion of its assets, upon which you will be notified via email and/or a prominent notice on our Web site of any change in ownership or use of such information, as well as any choices you may have regarding this information.
  4. Your Opt-Out Rights
    1. You may, at your sole discretion, opt to stop all collection of information by the Application by uninstalling the Application.
    2. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.
    3. You may also request to opt-out via email, at kava@kava.africa
    4. You irrevocably acknowledge and hereby agree to not hold Kava liable and/or responsible for any loss of information or damage incurred by you or any 3rd Party, subsequent to or in the course of your opting out or removal of the Application from your device.
    5. You further irrevocably agree to indemnify Kava for any loss of information or damage incurred by Kava subsequent to or in the course of your opting out or removal of the Application from your device.
  5. Data Retention Policy, Managing Your Information
    1. You irrevocably acknowledge and agree that Kava may, in its sole and unfettered discretion, retain User-provided data  in the course of your usage of the Application and even well after your opting-out or cessation of usage of the Application.
    2. Kava shall retain such Automatically Collected information for a period of up to thirty six (36) Months and thereafter, may store it in aggregate.
    3. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us at kava@kava.africa upon which Kava may respond within a reasonable time.
    4. You irrevocably acknowledge and agree that some or all of the User Provided Data may be required in order for the Application to function properly.
    5. You irrevocably acknowledge and hereby agree to not hold Kava liable and/or responsible for any loss of information or damage incurred subsequent to or in the course of Kava retaining such Automatically-Collected Information.
    6. You further irrevocably agree to indemnify Kava for any loss of information or damage incurred subsequent to or in the course of your opting out or uninstallation of the Application from your device.
  6. Children
    1. We do not use the Application to knowingly solicit data from persons under the age of 18.
    2. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at kava@kava.africa
    3. Kava shall delete such information from our files within a reasonable time.
    4. You irrevocably acknowledge and hereby agree to not hold Kava liable and/or responsible for any loss of information or damage incurred as a result of such information being provided to us either knowingly or unknowingly,  as a result of a child accessing the Application from your device.
  7. Security
    1. We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application.
    2. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.
    3. You irrevocably acknowledge and hereby agree to not hold Kava liable and/or responsible for any loss of information or damage incurred as a result of occurrence of such security breaches.
  8. Changes
    1. You irrevocably acknowledge and agree that this Privacy Policy may be updated from time to time for any reason that may be within Kava’s knowledge and at Kava’s sole discretion.
    2. You irrevocably acknowledge and agree that Kava shall not be obligated to disclose to you any reason(s) informing its changing or updating of this Privacy Policy.
    3. Kava may notify you of any changes to our Privacy Policy by posting the new Privacy Policy here and informing you via email or text message.
    4. You are advised to consult this Privacy Policy regularly for any changes, as by continuing to use the Application in the course of Kava effecting such changes, you will be deemed to have acquiesced to such changes and/or updates in the event of not raising any concern(s) to Kava regarding such changes and/or updates in the course of your usage of the Application.
  9. Your Consent
    1. By using the Application, you consent to Kava’s processing of your information as set forth in this Privacy Policy at present and as may be amended by Kava from time to time.
    2.  “Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the Republic of Kenya.
    3. If you reside outside the Republic of Kenya, your information will still be transferred, processed and stored under Kenya’s existing and applicable privacy policies and standards as at the time of your residence.
